Why is advertised hard drive size larger then actual size?

My ps3 is supposed to have a 40 gig hard drive, yet it only has 37 gigs of space. I've done some research and found that hard drive manufacturers use a different formula to calculate disk size. Why do they do this, and why isn't it false advertising?
